FILE STORAGE, RETENTION AND DESTRUCTION POLICY

During the course of Fitzgerald Law Office’s work, clients may provide Fitzgerald Law Office with documents or other items which will be maintained in Fitzgerald Law Office’s files. Fitzgerald Law Office will retain original documents at their discretion.

Fitzgerald Law Office will retain any correspondence, account statements, court documents, tax returns, and other materials for seven (7) years. Fitzgerald Law Office may, at their discretion, retain any document in a digital format such as a .pdf file.

After seven (7) years Fitzgerald Law Office may, at their discretion, destroy all documents and other materials in a client file. Fitzgerald Law Office will notify the client and offer to return any original documents before destruction. For this purpose, Fitzgerald Law Office will contact the client by U.S. mail at the last known address appearing the client file.

All of the attorney’s work product will be owned by Fitzgerald Law Office. Notes, memos, spreadsheets, drafts, and similar documents are work product that belongs to Fitzgerald Law Office. Fitzgerald Law Office will preserve or destroy work product at its discretion.

Fitzgerald Law Office will retain original estate planning documents in its files. Fitzgerald Law Office may, at its discretion, file any original Last Will and Testament held in its possession with the Washington County Register in Probate.
